Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Buslyft Metaride (Pty) Ltd, a subsidiary of Kavod Technologies (Pty) Ltd, a company registered in the Republic of South Africa ("Buslyft", "we", "us", or "our"). By accessing or using the Buslyft platform, mobile applications, website, or any services offered through them (collectively, the "Platform"), you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, and any additional policies referenced herein. If you do not agree to these Terms, you must not access or use the Platform.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that you are of legal age and have the capacity to enter into a binding agreement under South African law. Minors under the age of 18 may only use the Platform under the supervision and with the consent of a parent or legal guardian, who shall be responsible for the minor's use.
3. Description of Services
Buslyft Metaride is a multi-modal mobility and logistics platform that provides technology services connecting riders, drivers, commuters, and businesses. Our services include but are not limited to:
- On-demand ride-hailing (Buslyft, Spark, Taxi)
- Scheduled and recurring commute passes
- Charter and group transport services
- Parcel and package delivery
- School transport services
- Food delivery (Flyt Eats)
- Vehicle marketplace (Automovil)
- Freight and cargo logistics (Cargohual)
- Corporate travel management (Buslyft for Business)
- Digital wallet and payment services
Buslyft acts as an intermediary technology provider. We do not provide transportation services directly and are not a carrier or transport operator as defined under the National Land Transport Act 5 of 2009 ("NLTA"). Drivers using the Platform are independent contractors, not employees of Buslyft.
4. User Accounts
4.1 Registration
To use the Platform, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4.2 Account Security
You must immediately notify us of any unauthorised use of your account or any other breach of security. We are not liable for any loss arising from unauthorised use of your account where you have failed to maintain adequate security of your credentials.
4.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have breached these Terms, engaged in fraudulent activity, posed a safety risk, or for any other lawful reason. You may terminate your account at any time by contacting support or through your account settings.
5. Payments and Fares
5.1 Fare Calculation
Fares are calculated based on factors including distance, estimated duration, demand, service type, tolls, and applicable surcharges. Fare estimates provided before a trip are non-binding and may differ from the final fare. In accordance with the Consumer Protection Act 68 of 2008 ("CPA"), we will always display the final fare or a clear estimate before you confirm a booking.
5.2 Payment Methods
You may pay for services using credit or debit cards, the Buslyft Wallet, EFT, mobile money, or cash (where available). By adding a payment method, you authorise us to charge the applicable amount for services rendered. All amounts are in South African Rand (ZAR) unless otherwise stated.
5.3 Cancellation Fees
A cancellation fee may apply if you cancel a trip after a driver has been dispatched and has arrived or waited beyond the allocated free waiting period. The cancellation fee amount will be displayed in the app before you confirm the cancellation.
5.4 Refunds
Refund requests are evaluated on a case-by-case basis. If you believe you have been incorrectly charged, you may raise a dispute through the app or by contacting our support team within 7 days. We will process valid refunds within 10 business days, in compliance with the CPA.
6. User Conduct
When using the Platform, you agree not to:
- Violate any applicable laws, regulations, or third-party rights
- Use the Platform for any unlawful, fraudulent, or harmful purpose
- Harass, threaten, or discriminate against any driver, rider, or other user
- Damage, disable, or impair the functioning of the Platform
- Use automated scripts, bots, or scrapers to access the Platform
- Create multiple accounts to circumvent restrictions or suspensions
- Provide false or misleading information during registration or use
- Transport illegal substances, weapons, or hazardous materials
- Engage in price manipulation or fare fraud
7. Safety
Safety is a core priority. All drivers on the Platform are required to hold valid driving licences, professional driving permits (PrDPs) where required under the NLTA, and pass background verification checks. All vehicles must be roadworthy, insured, and comply with municipal and provincial regulations.
You agree to comply with all safety features, including sharing your trip with trusted contacts, using the in-app emergency button when necessary, and complying with driver safety instructions during the trip.
8. Intellectual Property
The Platform, including all content, features, functionality, software, designs, text, graphics, logos, and trademarks, is owned by Buslyft Metaride (Pty) Ltd or its licensors and is protected by South African and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes in accordance with these Terms.
9. Limitation of Liability
To the maximum extent permitted by law, including the CPA, Buslyft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform. Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amounts paid by you to Buslyft in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under South African law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
10. Indemnification
You agree to indemnify, defend, and hold harmless Buslyft Metaride (Pty) Ltd, Kavod Technologies (Pty) Ltd, and their respective directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your use of the Platform, or your violation of any applicable law or rights of a third party.
11. Dispute Resolution
Any dispute arising out of or in connection with these Terms shall first be subject to good faith negotiation between the parties. If the dispute is not resolved within 30 days, either party may refer it to mediation under the rules of the Arbitration Foundation of Southern Africa (AFSA). If mediation fails, the dispute shall be resolved by arbitration under AFSA rules. The arbitration shall take place in Cape Town, South Africa, and be conducted in English.
Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction. You also retain your rights to lodge a complaint with the National Consumer Commission under the CPA.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. The courts of the Western Cape Division shall have jurisdiction over any matter arising under these Terms, subject to the dispute resolution process outlined above.
13. General Provisions
13.1 Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and any service-specific terms, constitute the entire agreement between you and Buslyft regarding your use of the Platform.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.3 Waiver
No failure or delay by Buslyft in exercising any right under these Terms shall constitute a waiver of that right.
13.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. Buslyft may assign its rights and obligations to any affiliate or successor entity.
